Definitions
"We", "Us" or "Our" = Saltwater Campers Cornwall, the trading name of Mrs Lisa Nicholls, operating as a sole trader;
"You" or "Your" = the person who has entered into the contractual agreement to Hire the motorhome;
"Motorhome" = Peugeot Elddis Majestic 180 motorhome with the registration plate number HV63 UHM;
"Hire" or "Hire Period" = the period of time for which you take occupancy of the Motorhome, in accordance with the Hire Contract;
"Hire Contract" = the contractual agreement which governs the temporary arrangements for you to use the Motorhome;
"Season" = the months of the year denoted by Low, High and Peak on our pricing page;
Pre-hire arrangements
1. Deposit and payment
1.1. To secure a Hire booking, a non-refundable deposit of 25% of the total hire cost is required to be paid.
1.2 The balance of the Hire cost must be paid six weeks prior to the commencement of the Hire period.
1.3. The payment of the deposit and the balance can be made by bank transfer and are considered to be received once funds have cleared into Our bank account.
2. Cancellation
2.1. The deposit is non-refundable because once booked, we secure the booking to ensure that the Motorhome is reserved to You and not available to anyone else during the Hire Period.
2.2. If you cancel your booking after the date the balance has been paid, or is due to be paid (6 weeks prior to the Hire Period), the balance is non-refundable. We will endeavour to make the Motorhome available for hire and if we are able to secure an alternative booking during the same Hire Period, we will refund You the balance of Your booking (excluding the deposit), less an administration fee of £50.00.
2.3. If you need to change the dates of Your Hire at any stage after You have paid Your deposit, but before the date the balance is due, we can transfer Your deposit to Your amended Hire dates, subject to availability and provided the amended Hire dates are in the same Season. If Your rearranged Hire dates fall into a Season different to your original booking, the cost of the balance will be amended to reflect the cost of the Hire in that Season. This may result in Your Hire deposit cost increasing.
2.4. If you need to change the dates of Your Hire after the date that the balance has been paid (or is due to be paid), We will usually agree to transfer Your Hire Period at no additional cost to You, subject to availability and provided the amended Hire dates are in the same Season. The balance will remain payable for the date of the original Hire Period, even if the rearranged Hire dates are after the original Hire Period. If Your rearranged Hire dates fall into a Season different to your original booking, the cost of the balance will be amended to reflect the cost of the Hire in that Season. This may result in Your Hire balance cost increasing.
2.5. In the event that You have not satisfied these terms and conditions, or the terms of the Hire Contract, We may need cancel Your Hire on the basis that it cannot be fulfilled. Any deposit and hire costs paid by You are not refundable and We will deem any material non-compliance with these terms and conditions as Your instructions to cancel Your Hire.
2.6. In the event that We cancel Your Hire in any circumstances, We will refund You the total amount You have paid to Us as soon as reasonably possible. We will make all reasonable effort to ensure that We do not cancel Your Hire and any cancellation is likely to be limited to circumstances where the Motorhome is deemed unroadworthy as a result of previous use.
2.7. We strongly recommend that you take out travel insurance to cover your Hire costs and any unforeseen need to cancel Your Hire.
3. Security Deposit
3.1. We require payment in cleared funds of £750.00 as a security deposit before We can release the Motorhome to You for Your Hire. Provided these terms and conditions are met, particularly relating to the return of the Motorhome, we will refund this deposit to You in full within 10 days of the Motorhome being returned (or if that is not possible for any genuine reason, as soon as reasonably possible thereafter). This is subject to there being no outstanding insurance claims relating to Your Hire.
3.2. We reserve the right to retain the security deposit in full or in part, in order to recover the cost of any damage to the Motorhome, other vehicles or other property (whether or not those costs may be recoverable as part of any insurance claim), payment of the insurance excess fee, any speeding fines, parking fines or other charges which occur during the Hire Period, or any failure to adhere to these terms and conditions and/or Your Hire Contract.
3.3. You are not entitled to any interest payment during the period of time We hold Your security deposit.
4. Insurance
4.1. The Motorhome is covered by a fully comprehensive policy of insurance and provided You comply with these Terms and Conditions and the terms of the Hire Contract, the named individuals in the Hire Contract will be insured for accidental damage caused to the Motorhome and any third party vehicle, consistent with the terms of that insurance policy.
4.2. There is an excess fee of £750.00 payable by You in the event of any claim made on that insurance policy. We reserve the right to retain the security deposit to cover this excess payment in the event that an insurance claim is made, or deemed neessary to be made by Us.
4.3. The insurance policy is subject to exclusions which will be explained upon booked.
4.4. If you are involved in a road traffic collision or otherwise become aware of damage caused to the Motorhome, or another third party vehicle or property as a result of driving, parking or the positioning of the Motorhome, You must notify Us immediately. This is irrespective of whether the damage is Your fault, however minor you perceive the damage to be or whether it will give rise to an insurance claim. The recovery of Your security deposit and any other liability may be conditional upon this notification. You and any other adult travelling with you should take all reasonable steps to make a detailed, written statement setting out what happened as You (or they) witnessed it. You should take photographs showing the damage and showing the cause of the damage, including damage to a third party vehicle or property. You should make a written record of the names, addresses, email addresses and contact numers of any other third parties and their insurance details of those involved in the road traffic collision or the events giving rise to the damage. You should take all reasonable steps to take the names, address, email addresses and contact numbers of any witnesses and obtain details of any attending police officers, including any crime or other identifying reference number. You are prohibited from saying anything which might compromise the integrity of any insurance claim, including making any admission of liability.
5. Identification and named drivers
5.1. In order to drive the Motorhome, You must be between the ages of 25 and 70, have a valid driver's licence, with no more than three, current penalty points and be able to legally drive a vehicle of the specifications of the Motorhome (which includes a weight of 3,500 kilograms).
5.2. We require You to prove who You are, where You live and that You have the right to drive lawfully in the UK. This identification must be provided for each driver who intends to drive the Motorhome and must be a valid driver's licence, a valid passport, and a utility bill in the name of each driver that is dated within the three months prior to the Hire.
5.3 The insurance policy allows a maximum of two named drivers for the period of Your Hire. Each driver declare any insurance claims made in the three years prior to the Hire and must sign the warranties attached to the Hire Contract to declare that they meet the requirements of the insurance policy.
5.4. The driver must not be subject to any exclusions, including any excluded occupation, to be insurable.
5.5. The driver who was driving at the time any speeding fine, parking tickets or other fine or liability is incurred is personally responsible for payment of that fine, including any other penalty, interest or other sanction imposed during the Hire. We will redirect any penalty, fine or other sanction to You and notify You of Your responsibility to pay it.
During the Hire
5. Collection
5.1. We will arrange a time on the day of Your Hire for You to collect the Motorhome. We will spend time showing You how to operate the main controls and features of the Motorhome upon collection and this process can take up to an hour. Any named driver for Your Hire must be present to be shown those controls and features and We ask that you follow the instructions given about the use and operation of the Motorhome.
5.2. We supply the Motorhome with one set of keys, at least one full tank of LPG, a full tank of diesel, a full tank of fresh water, one steering lock and it will be clean and in good, working order, internally and externally.
6. Using the Motorhome
6.1. The Motorhome should only be driven on roads designated as public roads (as defined by section 192 Road Traffic Act 1988) and includes A-roads, B-roads, C-roads and motorways, or any private road or property for which You have permission or lawful excuse to use., such as a campsite or similar alternative. You should not drive on land which is reasonably inaccessible in the Motorhome or on any road or land which might cause unnecessary damage to the Motorhome.
6.2. The Motorhome has six seats, each with three point seatbelts. When driving the Motorhome, You are limited to a driver and a maximum of five passengers and each of the driver and passengers must wear the seatbelt provided. Any child passengers should sit in legally compliant child seats (these are not provided as part of Your Hire) and you must secure them in the Motorhome before driving. There are no isofix points in the Motorhome and seats must be secured using a seatbelt.
6.3. When parking the Motorhome overnight in a car park, You should ensure that the Motorhome is locked and secured, with the steering lock limiting the steering wheel from being able to turn. The handbrake should be engaged and the Motorhome should be level using the levelling ramps provided, if necessary.
6.4. If You leave the Motorhome unoccupied at any time, You must ensure that it is locked, secure and all reasonable security measures have been taken, including but not limited to, the steering wheel lock engaged.
6.5. We provide You with a full tank of diesel upon collection. You will need to return the Motorhome at the end of Your Hire with a full tank of diesel. When filling the Motorhome with fuel, You must ensure that You only use diesel to do so and do so in a safe manner. You are responsible for any costs associated with the wrong fuel being used and You should seek advice from an expert and notify Us immediately in circumstances where the wrong fuel is used in the Motorhome
6.6. We provide You with at least one full tank of LPG. You should take all reasonable steps to follow the instructions provided to You about how to safely use the LPG. In the event of a fire, You should take all reasaonble steps to ensure the safety of You and Your passengers, as well as to protect the Motorhome and any other property.
6.7. If You break any item of property provided by Us to You as part of Your Hire, or any part or feature of the Motorhome, You must notify Us as soon as reasonably possible after the breakage. This will enable Us to try to source a replacement ahead of the next user. We reserve the right to withhold part or all of the security deposit to cover the cost of any replacement item.
6.8. You must take all reasonable steps to ensure that the Motorhome is kept reasonably clean throughout the Hire. You are prohibited from smoking, and prohibited from allowing anyone else to smoke, cigarettes or e-cigarettes anywhere inside the Motorhome at any time during Your Hire.
6.9. You are allowed to take Your dog or dogs (up to a maximum of two dogs) in the Motorhome with You during Your Hire. You must ensure that You do act responsibly at all times, both in relation to the welfare of Your dog or dogs, and the cleanliness of the Motorhome. Dogs are not permitted to climb onto, stand, sit or lie on any upholstered seats or beds in the Motorhome. You are responsible for ensureing that any carpets or any interior of the Motorhome is not unreasonably soiled or made unreasonably dirty.
7. Mileage and limitations
7.1. We do not impose any mileage limitation during Your Hire, but You are strictly not permitted to drive or take the Motorhome outside of Great Britain at any time during Your Hire.
End of the Hire
8. Return
8.1. You are required to return the Motorhome to the agreed delivery location by no later than midday (12pm) on the final day of your Hire Period. We will need to carry out a detailed inspection of the Motorhome, which may take p to 45 minutes and We require You to be presented for the duration of the inspection. If there is any damage to the Motorhome, or to any property in or on the Motorhome, You will be required to provide Us with detailed explanation of how the damage was caused (if You hadn't already reported it to Us) and the return of the security deposit and any other liability is subject to the extent of any damage caused.
8.2. We ask that Your return the Motorhome with a full tank of diesel and with all property that was in or on the Motorhome when You collected it still present and intact. If You return the Motorhome without a full tank of diesel, We will deduct the cost of filling up the tank from Your security deposit before returning the balance to You, together with an inconvenience fee of £25.
8.3. You must return the Motorhome in a reasonable state and reasonably clean. We do not expect You to clear the Motorhome, unless it has been unreasonably solied. You must empty the grey waste tank, remove any of Your belonging and waste, empty and rinse the toilet and ensure that the Motorhome is reasonably tidy. If the Motorhome is returned unreasonably dirty, we reserve the right to deduct a cleaning fee of £100 from Your security deposit.
8.4. If Your return the Motorhome later than midday on the last day of Your Hire, we reserve the right to deduct any cost and/or loss associated with the late return. This may include exceptional cleaning costs, the cancellation of a subsequent booking and any insurance or other costs caused by the late return. If the loss caused to Us by You as a result of Your late return exceeds the total amount of Your security deposit, You agree to pay Us immediately upon request any surplus amount reasonably requested in order to compensate any third party for any loss or inconvenience caused by Your late return.
9. Legal ownership and rights.
9.1. The Motorhome remains Ours and any rights temporarily transferred to You during Your Hire are limited to those contained in these terms and conditions and the Hire Contract. You are strictly not entitled to sell, gift, loan or hire the Motorhome to any third party and You must not act in any way imply, deliberately or otherwise, that You have any right over the Motorhome not conferred to You temporarily through the Hire Contract. You have no right of ownership of the Motorhome at any time and the fact that We allow You to use the Motorhome for the duration of the Hire does not imply or suggest otherwise.
9.2. You must return the Motorhome to Us promptly in an undamaged state as soon as is reasonably practicable if We request You to do so. We will not exercise this right unreasonably. If You fail to return the Motorhome within a reasonable period of time after we request You do so (however that request is made), or by midday on the final day of Your Hire, We reserve the right to contact the police to report the Motorhome as having been stolen. We accept no liability for any criminal or civil sanction imposed as a result of Your failure to comply with this clause.
